SELLER DATA ACCESS AND USAGE CONSENT DECLARATION
This Declaration is made and executed by the undersigned Seller ("Seller") in favour of JGS Jaipur Global Services Pvt. Ltd. ("JGS"), a company incorporated under the Companies Act, 2013, having its registered office at Bangalore, Karnataka, and its operational office at Jaipur, Rajasthan.
1. Consent for Data Access and Use
The Seller hereby grants explicit, informed, and unconditional consent to JGS to access, collect, retrieve, store, process, analyze, and utilize business-related and customer-related data, including but not limited to:
- Product and catalog information
- Order and shipment details
- Customer data (name, address, contact number, etc.)
- CRM records and communication history
- Refund and return transactions
- Payment and settlement data
- Inventory and stock records
- Advertising, marketing, and campaign performance metrics
- Marketplace insights and operational analytics
2. Purpose of Data Usage
The Seller acknowledges and agrees that JGS may use the above data for lawful and legitimate business purposes, including:
- Business analysis and performance optimization
- Financial and accounting analysis
- Sales and marketing strategy development
- Reporting and statutory compliance
- Product and service enhancement
- Internal operational improvements
- Customer experience and support activities
3. Duration and Revocation
This consent shall remain valid until expressly revoked by the Seller by way of a written notice addressed to JGS and acknowledged in writing by an authorized representative of JGS. Any lawful data processing carried out prior to such revocation shall remain unaffected.
4. Legal Authority
The Seller confirms that they are duly authorized to execute this Declaration and grant consent on behalf of the business entity associated with the data. The Seller assumes full responsibility for the accuracy, legality, and authenticity of the data shared.
5. No Further Consent Required
The Seller agrees that JGS shall not require any additional approval for accessing or using the data within the scope defined in this Declaration.
6. Data Protection and Compliance
JGS shall implement reasonable security measures and ensure compliance with all applicable laws, including but not limited to:
- The Digital Personal Data Protection Act, 2023
- The Information Technology Act, 2000 and its associated rules
- The Consumer Protection (Ecommerce) Rules, 2020
- Any other relevant notifications or guidelines issued by competent authorities
7. Limitation of Liability
The Seller agrees that JGS shall not be held liable for any claims, damages, or actions arising from the use of data in accordance with this Declaration, provided that such use complies with applicable law and the terms herein.
8. Notice and Acknowledgment
The Seller hereby acknowledges that they have been clearly informed regarding:
- The nature and categories of data to be collected
- The specific purposes for which the data will be processed
- The grievance redressal procedure
- The right to withdraw consent at any time
- The contact details of JGS's Data Protection Officer (if applicable)
9. Execution and Acceptance
By signing this Declaration, the Seller confirms that they have read, understood, and voluntarily agreed to the terms herein, without coercion, misrepresentation, or undue influence.
